1. Operator Identity and Scope
These Terms and Conditions (“Terms”) govern the contract between Tour Expert (the “Operator,” “we,” “us,” “our”) and the client (“you,” “Traveller”) for the booking of tours, guided experiences, transfers, and related travel services (“Services”) offered via tourexpert.co.

Tour Expert holds a valid tour operator licence under the Polish Act of 24 November 2017 on Package Travel and Linked Travel Arrangements (Ustawa o imprezach turystycznych i powiązanych usługach turystycznych, Dz.U. 2017 poz. 2361, as amended by the Act of 7 November 2025), implementing EU Directive 2015/2302 as amended by EU Directive 2026/1024.
2. Definitions
- Package Tour: A combination of at least two different travel services (transport, accommodation, guided tours, or other services) purchased together for the same trip.
- Day Tour / Experience: A single travel service (typically a guided tour of one day or less) not combined with accommodation or transport into a package.
- Traveller: Any person who has concluded a booking contract, or on whose behalf a booking has been made.
- Organiser: Tour Expert, acting as the organiser of the package or provider of the individual service.
- Extraordinary Circumstances: Unavoidable and extraordinary circumstances at the destination or in its immediate vicinity that significantly affect the performance of the tour, including but not limited to armed conflict, natural disasters, pandemic-level health emergencies, or official government travel advisories recommending against travel.
3. Booking and Contract Formation
3.1 A binding contract is formed between Tour Expert and the Traveller upon: (a) completion of the online booking process on tourexpert.co and receipt of a booking confirmation email from Tour Expert; or (b) written acceptance by Tour Expert of a booking request submitted by enquiry form, email, or telephone.
3.2 The Traveller completing the booking warrants that they are aged 18 or over, have legal capacity to enter into a contract, and accept these Terms on behalf of all members of their travelling party.
3.3 Tour Expert reserves the right to decline any booking at its sole discretion, in which case any payment received will be refunded in full within 14 days.
3.4 Bookings made through third-party platforms (ToursByLocals, TourHQ, Viator, GetYourGuide) are subject to those platforms’ own booking terms in addition to these Terms to the extent not inconsistent.
4. Pricing and Payment
4.1 All prices are displayed in EUR (Euro) unless otherwise stated. Prices are inclusive of VAT (where applicable under Polish tax law) and all stated inclusions.
4.2 Day tours and experiences: Full payment is required at the time of booking unless a deposit arrangement is expressly stated on the tour page.
4.3 Multi-day packages (2+ days): A non-refundable deposit of 30% of the total tour price is required to confirm a booking. The remaining balance is due no later than 60 days before the tour departure date. For bookings made within 60 days of departure, full payment is required at the time of booking.
4.4 Partial payment options, where offered, are subject to the payment schedule set out at the time of booking.
4.5 Tour Expert reserves the right to increase confirmed tour prices only where specifically permitted under Article 21 of the Polish Package Travel Act, and only to reflect documented increases in: fuel or other energy costs; third-party taxes, fees, or levies; or applicable exchange rates. Price increases exceeding 8% of the total package price entitle the Traveller to withdraw from the contract without penalty.
4.6 Tour Expert will notify the Traveller of any price increase no later than 21 days before the departure date. Price reductions shall be passed on to the Traveller accordingly.
5. Cancellation by the Traveller
5.1 Cancellations must be notified to Tour Expert in writing (email to info@tourexpert.co). The cancellation takes effect on the date the written notice is received by Tour Expert.
5.2 The following cancellation charges apply to day tours and experiences:
- More than 48 hours before the tour: Full refund.
- 24–48 hours before the tour: 50% of the tour price retained.
- Less than 24 hours before the tour or no-show: 100% of the tour price retained.
5.3 The following cancellation charges apply to multi-day package tours:
- More than 60 days before departure: Loss of deposit (30%) only.
- 30–60 days before departure: 50% of total tour price.
- 15–29 days before departure: 75% of total tour price.
- Less than 15 days before departure or no-show: 100% of total tour price.
5.4 In the event of Extraordinary Circumstances at or affecting the tour destination, the Traveller has the right to cancel any booking (including package tours) without payment of a cancellation charge, and is entitled to a full refund within 14 days of cancellation, in accordance with EU Directive 2026/1024 and the Polish Package Travel Act.
5.5 Tour Expert strongly recommends that all Travellers obtain comprehensive travel insurance covering cancellation, medical expenses, and personal liability.
6. Cancellation or Alteration by Tour Expert
6.1 Tour Expert reserves the right to cancel any tour where minimum participant numbers are not met. Where a tour is cancelled by Tour Expert for any reason other than Extraordinary Circumstances, the Traveller shall receive: (a) a full refund of all amounts paid; and (b) where a package tour is cancelled within 28 days of departure, compensation as follows: cancellation 14–28 days before departure — 5% of total price; 7–13 days — 10%; less than 7 days — 25%.
6.2 Tour Expert may alter tour itineraries, accommodation, transport, or other arrangements where necessary due to operational requirements, safety concerns, weather conditions, or force majeure events. Tour Expert will make reasonable efforts to provide equivalent alternatives.
6.3 Where a significant alteration is proposed to a confirmed package tour, the Traveller may accept the change, accept a substitute package (with a price adjustment where applicable), or withdraw from the contract with a full refund.
6.4 Tour Expert’s liability in the event of non-performance or improper performance of a package tour is limited to three times the total tour price per Traveller, except in cases of personal injury, death, or damage caused by intentional misconduct or gross negligence, where statutory liability applies without limit.
7. Tour Conduct, Health, and Safety
7.1 Tour Expert reserves the right to refuse participation or to remove from a tour any Traveller whose behaviour poses a risk to the safety, comfort, or enjoyment of other participants or Tour Expert staff, without any refund obligation.
7.2 It is the Traveller’s responsibility to ensure that all members of their party are in suitable physical condition to participate in the chosen tour. Some tours involve walking on uneven surfaces, stairs, or physically demanding terrain. Where relevant, this is indicated on the tour page.
7.3 The Traveller must inform Tour Expert in writing at the time of booking of any medical condition, disability, dietary requirement, or other special need that may affect their participation. Tour Expert will make reasonable efforts to accommodate special requirements but cannot guarantee this in all cases.
7.4 All Travellers participate in tours at their own risk in respect of personal accident, injury, illness, or loss or damage to personal property, except where caused by the negligence of Tour Expert or its employees.
8. Group and School Tours
8.1 Group bookings (6 or more Travellers) and school/educational tours are subject to a separate written agreement specifying group-specific pricing, payment schedules, minimum numbers, and supervision requirements.
8.2 Tour operators, travel agents, and educational institutions booking on behalf of Travellers accept these Terms on behalf of all individuals in their group and are jointly and severally responsible for payment.
8.3 For school tours involving minors (persons under 18), the booking institution confirms that adequate adult supervision (at a ratio of not less than 1 adult per 10 students) will be present throughout the tour, and that appropriate parental consent has been obtained.
9. Complaints and Dispute Resolution
9.1 Any complaint concerning a tour must be raised immediately with the Tour Expert guide or representative during the tour, to allow Tour Expert the opportunity to remedy the situation.
9.2 If the complaint cannot be resolved during the tour, the Traveller must submit a written complaint to Tour Expert within 30 days of the tour end date, to info@tourexpert.co.
9.3 Tour Expert will acknowledge receipt of complaints within 3 business days and respond substantively within 30 days.
9.4 Disputes arising from these Terms are subject to Polish law and the jurisdiction of the courts of Kraków, Poland. EU Travellers retain the right to bring a claim in their country of habitual residence under applicable EU consumer protection law.
